Showbiz Box Office and Showbiz.com.au (collectively referred to as the “Site”) is an online service owned and operated by Showbiz International Pty Ltd (ABN 40 085 982 789) hereinafter referred to as 'Showbiz'.

Please read the Terms of Use carefully before using this Site. By using or visiting the Site, you expressly agree to be bound by the following terms of use and all applicable laws and regulations governing the Site. If you choose not to be bound by the following Terms of Use then Showbiz does not grant you the right to use the Site and you must not use this Site.

Showbiz may vary these terms at any time. Any variations become effective on posting. By continuing to use the Site after the Terms of Use have been varied you agree to be bound by the variation.

The Contract
A contract shall be deemed to have been made between Showbiz and the Customer booking.

Services Provided
Showbiz is offering its services to the Customer as a purveyor of hotel rooms, food & beverage, ground transportation, hospitality and event ticketing to theatre, concert and sporting events.  Showbiz is acting as an intermediary and or agent for suppliers in selling event services or in accepting reservations or booking for event services which are not directly supplied by Showbiz.

Authorised Reseller
Showbiz is an authorised agent appointed by Sellers to sell tickets to Showbiz Affiliate Partners and Customers for events and as a component of travel and VIP packages with other Third Party Products and Services. When Showbiz sells a ticket of admission, Showbiz warrants that it is fully authorised to sell the ticket.

Permitted Use
You agree that you are only authorised to visit, view and to retain a copy of pages of this Site for your own personal use, and that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than to review event and promotional information, for personal use, or to purchase tickets or merchandise for your personal use, unless otherwise specifically authorized by Showbiz to do so. The content and software on this Site is the property of Showbiz and its Affiliates/Partners.

1. No Cancelations, Exchanges or Refands
   Once confirmed, bookings may not be cancelled, exchanged or refunded. Bookings are confirmed when full payment is received.

2. No Reselling
   This ticket and/or package must not be resold or offered for resale at a premium (including via online auction sites) or used for advertising, promoting or other commercial purposes (including competitions or trade promotions) or to enhance the demand for other goods an services, either by the original purchaser or any subsequent bearer. If a ticket is sold in breach of this condition, the ticket may be cancelled without a refund and the bearer of the ticket may be refused admission.

3. To Be Allocated Seating
   Showbiz International is not always advised of specific seat allocations at the time of sale and may only be selling a specific class of ticket (for example Gold, Silver, Bronze or A, B, C). Where Showbiz is unable to guarantee specific seating locations Showbiz cannot accept liability in respect of claims made by customers resulting from venue designation or allocation being perceived as below expectation. Travel agents have no authority to make representations as to the quality or location of seating without our express authority in writing.

4. Tickets Collection & Dispatch
   Tickets will be mailed four weeks prior to event date (earlier where possible) or will be available for collection at the event box office. Following business day, when referred to, does not include weekends or public holidays in Sydney.

5. Event Changes
   Information, cast and event dates are subject to change. Showbiz is not responsible for any cancellation or rescheduling of events or for changes in the programme or performers. In the case of rescheduling of an event, tickets will be transferred to the new date in accordance with the guidelines set out in the LPA Code of Practice for Event Ticketing in Australia www.liveperformance.com.au. 

   In the case of an event itself being cancelled or postponed you will be refunded the amount paid in full, less any service and handling fees. Showbiz reserves the right to retain any service fees and charges incurred on procuring hotel, hospitality and transfers arrangements including but not limited to deposits paid and forfeited. 
   
   However, if an event is cancelled or postponed after it has commenced, ticket holders will not have the right to exchange or receive a refund on tickets or packaged elements (hotel, hospitality and transfers).

6. Price Changes
   All prices are subject to change without prior notice until your booking is confirmed.

7. Full Payment Amounts to Confirmation
   Upon acceptance of the booking, the booking must be paid for in full immediately. Once a booking has been paid in full it is deemed confirmed, after which tickets and packages cannot be exchanged, cancelled or refunded.

8. GST
   All prices quoted are inclusive of the Goods and Services Tax (GST). In event of the rate of GST being increased between the acceptance of a booking and an event the client shall be liable to pay such increase before tickets are issued.

9. Package Prices
   All prices published for each package are per person rates. [Concern: not per person when testing website for hotels]

10. Pricing Policy and ShowSafe Guarantee
    Showbiz offers a 100% ShowSafe buyer guarantee for all ticket bookings. 

    When you complete your purchase and receive your Showbiz purchase confirmation email from us, we offer a money back guarantee that;

    1. Your ticket(s) and any associated package products are 100% authentic. All Showbiz tickets and packages are acquired and/or developed with the full approval of the event promoter/producer, and where required, under duly authorised commercial supply arrangements with ticket agents and/or venues.
    
    
    
    2. You'll receive your tickets vouchers or documents for your confirmed purchase well before the date and time of your chosen event.  All documents relating to your purchase will be mailed out to you approximately 30 days prior to your event to ensure you receive your tickets at least 2 to 3 weeks before the date of your selected show. Please note if you make your purchase less 30 days from the event, your tickets and documents may need to be collected at the box office on the day of the performance you will be attending, or delivered to you by express post or courier for an additional fee.
    
    
    
    3. Selected seats in any single transaction will be located side-by-side unless stated otherwise.
    
    
    
    4. Showbiz will advise of any limitations, restrictions, or special conditions relating to the event and will disclose all the information available regarding the specific seats or seating area for a given performance during the ticket booking. 
    
    
    
    5.  In the event that specific seat selection has not been confirmed at the time of your booking, Showbiz will still guarantee that you will receive seats for whichever seat category you choose to purchase and will let you know prior to purchase by displaying TBA in the seating allocation.  For example, if you purchase Gold seating, we guarantee you will be seated in the Gold section.  Specific seat locations will be finalised closer to the event and will be confirmed on your ticket(s). 
    
    
    
    6.  Showbiz' ticketing services strictly abide by the "Code of Practice for the Ticketing of Live Entertainment in Australia" defined by the industry regulatory association, Live Performance Australia. Showbiz is a participating and active member of Live Performance Australia and is committed to the development of the Australian live performance industry.

    If we have not met any of the above conditions in our ShowSafe Guarantee, please let us know immediately so that we can arrange a refund.

    All stated and package prices are inclusive of GST. Showbiz's advertised ticket and package prices include the base supply cost of the ticket/s, plus any premium and/or pre-sale access fees and ticket agent or service fees levied by the supplier/s and charged to Showbiz to secure allocations, plus a Showbiz service fee of not more than 15% of the total supply price.

    Any ticket fees and charges above the face value printed on tickets reflects the cost of obtaining seating, and includes fees charged for securing premium or VIP seating, and/or pre-sale access and is based on market demand, and seat availability and location on the available date on offer. Showbiz at all times uses its best endeavours to ensure the supply price of the tickets is a fair market rate relative to the quality seating allocations we secure from promoters and producers.

    This pricing policy and ShowSafe guarantee apply to all bookings completed through the Showbiz Box Office website and/or through our 1 300 4 SHOWS Retail Call Centre.

11. Booking Fee
    A booking/handling fee is charged per booking, this fee is not included within the ticket price.

12. Packages Product Information Disclaimer
    Hotel, restaurant and other third party hospitality product descriptions are based on current hotel guides and contractual agreements provided by hotels and suppliers. Any facilities shown as included are subject to change at any time. The standards of accommodation and other services are based on various factors, which are generally accepted as indicative of a certain class; however we do not represent or guarantee the standard, class or fitness for purpose of that accommodation or service.

13. Hotel Cancellation Fees
    Hotel cancellation fees will apply and are determined on a case by case basis and are subject to agreements between Showbiz and the hotel management. In the case of an event being cancelled or re-scheduled the monies paid for the accommodation component of the package is non-refundable.

14. Hotel Check in/out
    Generally hotel check-in is 3pm and most hotels expect departing guests to vacate rooms by 10am on the date of departure to allow for cleaning and maid service.

15. Travel Insurance
    Where accommodation and/or travel arrangements are included in your booking we strongly recommend that you purchase a comprehensive travel insurance policy.

16. Lost Tickets
    When allocated seating tickets are lost or stolen the Customer must be able to produce proof of their original purchase prior to a Lost Ticket Voucher being issued. Replacement of lost tickets is subject to the venue and or ticket agents lost ticket replacement terms and conditions. Showbiz reserves the right to charge an administration fee if a lost ticket voucher needs to be issued.
    
    Showbiz reserves the right not to replace tickets where seating is not allocated (general admission).

17. Responsibility Agent
    Showbiz agrees to offer its services to the Customer as a purveyor of hotel rooms, ground transportation, hospitality and event ticketing to theatre, concert and sporting events. Showbiz is acting as an intermediary and or agent for suppliers in selling event services or in accepting reservations or booking for event services which are not directly supplied by Showbiz. 

18. Independent Contractors
    Services provided in conjunction with these events are rendered by suppliers acting as independent contractors and not as agents or employees of Showbiz. Showbiz therefore shall not be responsible for breach of contract for any intentional or careless actions or omissions on the part of such suppliers, which result in any loss, damage, delay or injury to the Customer or Customers travel companions.

19. Third Party Information
    Showbiz has/have utilised information provided by third party companies and all attempts have been made to ensure the accuracy of this information. Alterations and amendments can occur Showbiz cannot be held responsible.




20. Accepts No Liability for Acts by Others outside of Direct Control
    Showbiz finalises all arrangements upon the express condition that it shall not be liable, apart from non-excludable liability, for any injury, death, damage, loss, accident, delays, generally or irregularity which may be occasioned either by reason of any defect in any venue, or vehicle or through the acts of omission, default whether negligent or otherwise, of companies or persons engaged in connection with your booking pursuant to a contract between them and yourselves and over whom we have no direct and exclusive control.

21. Accepts No Liability for others Acts which are Not Preventable
    We do not accept liability in contract or in tort (actionable wrong) of any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force majeure or other events which are beyond our control or which are not preventable by reasonable diligence on our part including but not limited to war, civil disturbance, fire, floods, unusually severe weather, acts of God, acts of Government or of any other authorities, accidents to or failure of machinery or equipment or industrial action (whether or not involving our employees and even though such action may be settled by acceding to the demands of a labour group).

22. Independence
    Showbiz is an independently owned and operated business. Any reference to specific events herein is made only for clear identification and reference of potential purchases by customers of Showbiz and reference to an event is not intended to imply nor should it be understood or assumed that Showbiz is endorsed by, sponsored by, approved by or otherwise affiliated with the organisers and/or sponsors of the events herein.

23. Unenforceable
    If any part of this agreement is held to be unenforceable, the unenforceable part must be given effect to the greatest extent possible and the remainder will remain in full force and effect. This agreement is governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales, Australia.

24. Law & Construction
    The contract of these terms of use shall be governed by the law of the State of New South Wales and Showbiz and the client hereby submits to the exclusive jurisdiction the law of the State of New South Wales Courts in all matters regarding the contracts and these Terms of Use. All prices are subject to change should State or Federal Governments introduce a tax of any kind on our products.

25. Terms of Use / Privacy Policy
    The Showbiz Terms of Use and the Showbiz Privacy Policy are incorporated into these Terms of Sale and apply to all sales through this Site.
